This bill allows for a private right of action on any employment prohibited practice in RCW 49.44. We believe that enforcement mechanisms should be transparent and included in each bill, and not include a blanket private right of action for any subject attached to RCW 49.44. As an example, there are several bills moving through the system in 2023 that will be placed in RCW 49.44 (SB 5123 relating to cannabis in employment and SB 5417 relating to political speech). A private right of action should be transparent and not a default for any employment matter referenced in RCW 49.44. The business community is opposed to private rights of action because it is the least effective route to settle employment disputes, leads to unnecessary litigation, costs and delays. The business community prefers administrative remedies that settle disputes quickly. Adds penalties for the provisions in the Revised Code of Washington, Chapter 49.44 that do not already have specified criminal or civil remedies.
