Adding penalties for certain prohibited practices in chapter 49.44 RCW.

This bill allows for a private right of action on any employment prohibited practice in RCW 49.44. We believe that enforcement mechanisms should be transparent and included in each bill, and not include a blanket private right of action for any subject attached to RCW 49.44. As an example, there are several bills moving through the system in 2023 that will be placed in RCW 49.44 (SB 5123 relating to cannabis in employment and SB 5417 relating to political speech). A private right of action should be transparent and not a default for any employment matter referenced in RCW 49.44. The business community is opposed to private rights of action because it is the least effective route to settle employment disputes, leads to unnecessary litigation, costs and delays. The business community prefers administrative remedies that settle disputes quickly. Adds penalties for the provisions in the Revised Code of Washington, Chapter 49.44 that do not already have specified criminal or civil remedies.

Washington’s Stay at Work program, which has proven successful in helping injured workers transition back to the workplace – is limited to only the “employer of injury” SB 5368 will allow smaller employers and frontline workers, who may not have light duty work opportunities available for transitioning back to work, to partner with local non-profit organizations to offer light duty volunteer positions. The bill protects injured workers by providing an option to refuse, or terminate, a light duty position with a non-profit without any risk to their benefits and medical care SB 5368 is triple win --- allows small businesses and more injured workers to access light duty positions, assists injured workers in their transition back to work, and assists local non profits in their efforts to serve their communities. Allows an employer with 100 or fewer employees to offer off-site light duty work to a worker with an established nonprofit organization under the Stay-at-Work Program and to seek reimbursement for certain wages paid the worker and expenditures subject to certain conditions. • Allows the Department of Labor and Industries or the employee of injury to contract with an established return-to-work employment agency for the purpose of offering the work.

Prohibits any large gas company that serves more than 500,000 retail natural gas customers in Washington as of June 30, 2023, from furnishing or supplying gas service, instrumentalities, and facilities to any commercial or residential location that did not receive gas service or have filed applications for gas service as of June 30, 2023. • Requires a large gas company to file a gas decarbonization plan and an electrification plan with the Utilities and Transportation Commission (UTC) as part of any multi-year rate plan filed on or after January 1, 2026. • Requires the UTC to establish a target for a gas decarbonization plan and a cost target for an electrification plan, each of which must be 2.5 percent of the gas revenue requirement and electric revenue requirement, respectively, approved by the UTC for each year of the multiyear rate plan. • Requires that 60 percent of the total capacity and energy needed for a combination utility to meet the requirements of the Clean Energy Transformation Act must be supplied from resources owned and operated by the combination utility or an affiliate of the combination utility. • • Directs the UTC to adopt a merger of the rate bases supporting gas and electric operations of a combination utility into a single rate base if the ratio of the rate base for gas operations to the combined rate base of gas and electric operations is less than or equal to 0.2. • Establishes labor requirements for any project in a gas decarbonization plan or electrification plan with a cost of more than $1 million. • Encourages a variety of types of electric utilities to work with large gas companies providing gas service within the service areas of the electric utilities to identify opportunities for electrification and the provision of peaking service by the large gas companies.
