We are starting to see bills move and getting a better idea of what will continue on now that we are one week away from the February 17 committee cut off date.
For the business community the biggest concern is the sheer number of bad labor bills that are moving through the Legislative committees. This includes several bills in the Senate that triggered a letter this week from a large group of business entities. The bills highlighted on this list include:
SSB 5110 — Adding penalties for certain prohibited practices in RCW 49.44 —
This bill allows for a private right of action on any employment prohibited practice in RCW 49.44.
SSB 5217 — Concerning the state’s ability to regulate certain industries and risk classes to prevent musculoskeletal injuries and disorders — This overturns an initiative passed by the People in the early 2000s. This allows LNI to establish rules on industries that could require mandatory job rotation and hours restrictions.
SSB 5417- Protecting the rights of workers to refrain from attending meetings or listening to their employer’s speech on political or religious matters. This removes an employer's freedom to speak to employees about its view of the impacts of unionizing activity, and as such is preempted by the National Labor Relations Act.
A letter from the business community to the Senate has been drafted and will be sent up to all State Senators. A similar list and letter are being developed for the House as well.
Another concern overall is the number of bills with “private rights of action.” This is a concern for any business, local government, hospital or other entity that is concerned about the proliferation of lawsuits in today’s economy. I have attached a list of all of those bills for you to see.
Another letter being developed (and attached) is a letter on public safety being put together by the Association of Washington Business. They are opening up this letter for non-member signatories. I would like to add the South Sound Chamber Legislative Coalition as well as see which other chambers and businesses would want their name on this letter.
