The Legislature just passed it’s 6th cut-off point – the point in which bills had to be out of the opposite house in order to be considered alive for the remainder of the session (unless of course they are determined to be necessary to implement the budget or NTIB).  With the Senate being very careful about adding too much to the budget, we are hoping the NTIB list is very limited this session thus keeping bills dead.

 

Of note:

 

SSB 5110 died on the House floor.  This bill would have added a private right of action to all wage and labor standard violations that did not have a specific penalty structure in statute.  This would have created more situations where lawyers could have threatened businesses on behalf of employees.

 

SHB 1320 also died in Senate Ways and Means.  This bill would have created confusing, expensive standards for keeping and providing personnel records to employees – once again involving the use of attorneys to sue employers who did not meet the requirements.  The bill was costly for private employers but the state really didn’t listen until state agencies and other government entities started telling the committee how much this bill would cost them.

 

Both SB 5352 (Vehicular pursuits) and SB 5536 (Blake Decision Fix) both passed the House and are now back to the Senate for a concurrence/non concurrence vote.  It is likely these bills will end up in conference committee.

 

ESHB 1110, the middle housing bill passed the Senate and is now back to the House for a concurrence/non concurrence vote.

 

The House Finance Committee has moved the real estate excise tax increase bill (HB 1628) out of committee and into House Rules.  The bill has been modified to do the following: 

 

·       Adds a new state real estate excise tax threshold of $5,000,000 on January 1, 2025, with the portion of the selling price that is above the threshold taxed at a rate of 4 percent.

·       Provides for the distribution of the increase in revenue from the new threshold over what would have been collected had the new threshold not been imposed, including to a newly created Developmental Disabilities Trust Account that can be used for housing support for individuals with developmental disabilities.

·       Allows a county or city to impose an additional 0.25 percent real estate excise tax for the construction and support of affordable housing beginning January 1, 2024.

·       Removes the expiration date on the ability to use certain local government real estate excise tax funds for facilities for those experiencing homelessness or for affordable housing, and removes a $1,000,000 limit on the annual use of such funds in larger jurisdictions.

  • Removes certain restrictions on the permitted uses of revenue from specified local government real estate excise taxes, and allows for the councilmanic imposition of a 0.25 percent real estate excise tax by counties, and cities within those counties, that choose to plan under the Growth Management Act instead of requiring voter approval.
  • Creates a real estate excise tax exemption for certain sales or transfers of properties that qualify for a property tax exemption that will be used for a community purpose.

The Senate – in their attempt to provide more money for housing – has introduced SB 5770 – a bill that would increase the property tax from 1% as approved by voters, to 3%.  It also changes the definition of “inflation” to help increase the growth factor.
